To be fair, if I were BMB and I was writing a story and it called for a character I had already introduced to have a reason to hunt down Spider-man in public without giving up my secret identity, I would need a good costume.
Bendis probably figures if he's going to have a mysterious character in costume with a big reveal at the end of the arc on who it is, people are going to complain, "That's just like Ronin!" anyway, so he might as well use a character that comes attached with sign: "This character only exists as a secret identity, the fun in this comic will be guessing who it might be!"
