They don't have to be NEW this year past - perhaps its a comic that you think has had a fantastic year but is several years old... whatever - its your list :)
Here's mine:

5 - Fatale - Reads better, IMO, in trade, but a great read however you slice it. Brubaker/Phillips never make my #1 comic, but they are my #1 team for their CONSISTENCY!!
4 - Peter Panzerfaust - Not for everyone, but I'm loving the Pan in WW2 concept
3 - Thief of Thieves - Great story, and I love to picture the upcoming TV show!
2 - Saga - One of the very few comics that lives up to, and exceeds, the hype. Read the first 8 issues of Y:The last man and the first 8 issues of Ex Machina. I really think these 8 are better than those combined. This comic, and #1 are the two that I support in paper and digital format.
1 - Manhattan Projects - If you've made a list, and this isn't on it, I may not give your list a second glance. Its not that your list is crazy or wrong, its just that if your taste and mine overlap in any meaningful way, this would be on your list. I look at other people's lists to get ideas of what to check out. If Manhattan Projects isn't your cup of tea, its unlikely (though not impossible) that I'd find much on yours to check out. This comic is my new obsession!

Just missed -
Casanova - I don't know if enough came out in 2012, but a FANTASTIC, medium-pushing comic
Bedlam - 2 GREAT issues so far
Morning Glories - great, complexly (is that a word?) weaving story, but still too few answers
Prophet - Haven't yet read this, but sure looks great - the one I may regret not putting up there, according to many others
Mind the Gap - neat ideas, and I love the notes at the end of the single issues
Hawkeye - Immortal IF's team reunites for what is clearly my favourite superhero comic of 2012, challenged only by...
Avengers - Hickman's 2 issues here have me very interested
Legend of Luther Strode - GREAT issue, following a GREAT mini, but really, missed 2012

SO - IMHO, 2012 - the year of Image!

Now lets hear yours!

In no particular order:

The Manhattan Projects - FDR Supercomputer. Truman's White House orgy. Evil Einstein. What's not to love?
Saga - gorgeous art and a simple and effective story. Its like a primer on how not to suck.
Prophet - God damned insane. There are more big ideas in one issue of this then in either of the big twos line has in a month.
Casanova Avaritia - Half of this came out this year. I can't wait to see where it goes. Assuming it keeps going.
B.P.R.D - It's the biggest story in comics.

Honorable mentions to Fatale, Wonder Woman, Hickman's The Avengers, Batman and Remenders Captain America

And the most disappointing comics of 2012

Morning Glories - nothing ever gets resolved, more crap with no connection gets added every issue.
Avengers vs X-Men - It was a disjointed mess that ignored the fact that the villain was right. And not a villain until the end.
Stormwatch - Paul Cornel had a pretty sweet idea about showing the same team in two totally different time periods. Then he left half of it because editorial had other plans for Stormwatch. Plans that never did seem to happen.
Fantastic Four - I really thought Matt Fraction's style would be a good match for The Fantastic Four. Instead we get The Thing shouting dummies for pages, Jetson like mom bots, and the four being made of unstable molecules.
Action Comics - Grant Morrison on Superman. It wasn't amazing.
